I confini incerti dell’armonizzazione contabile delle pubbliche Amministrazioni italiane: una antologia di casi controversi

L’armonizzazione contabile delle pubbliche Amministrazioni italiane prende concreto avvio con la L.196/2009. Tale norma definisce un ambito di applicazione che genera una miriade di situazioni controverse, soprattutto in comparti diversi da quello degli Enti territoriali. L’obiettivo del presente lavoro consiste nell’analizzare e identificare l’effettivo insieme di aziende e di unità istituzionali soggette alle norme sull’armonizzazione contabile pubblica, circoscrivendo gli elementi di incertezza emersi in questi anni. La ricerca ha tenuto conto delle connessioni interdisciplinari ed è stata condotta con un metodo deduttivo-induttivo, coerente con l’approccio economico aziendale. Dall’indagine emerge la necessità di definire con maggior chiarezza l’ambito di applicazione delle norme sull’armonizzazione contabile. Con tale proposito, nelle conclusioni, è stata individuata una soluzione  normativa compatibile sia con la Costituzione italiana e con la normativa comunitaria sia con gli assunti teorici dell’economia aziendale.

Accounting harmonisation within the Italian Public Entities was implemented, in concrete terms, with Law 196/2009. This law defines a scope of application that generates a myriad of controversial situations, especially within areas other than those of the local bodies. The objective of this work is to analyse and identify the actual group of institutional units and companies subject to the standards and regulations for public accounting harmonisation, by circumscribing the elements of uncertainty that have emerged in recent years. The research has taken into account interdisciplinary links and has been carried out with a deductive-inductive method, in line with the business economics approach. The investigation reveals the need to define, with greater clarity, the scope of application of the accounting harmonisation standards and regulations. With this aim, the conclusions have identified a regulatory solution that is compatible with the Italian Constitution, the EU law, and the theoretical assumptions of business economics.
